Terms and Conditions of Service

  1. Acceptance of Terms. Welcome to Prescription-Mexico.com. By using the Prescription-Mexico.com web site at any time, you agree to be legally bound to the Terms and Conditions of Service listed on this page ("TCS"). If you do not want to be legally bound, or if you do not agree with the TCS, do not use the Prescription-Mexico.com web site. For the TCS, Prescription-Mexico.com refers to the website, its owners and its editors. The TCS may be updated by Prescription-Mexico.com from time to time without notice to you. You can review the most current version of the TCS as any time by checking the Terms of Service listed at the home page. We recommend that you check the TCS periodically for changes. Your continued use of the Prescription-Mexico.com web site following the posting of any of changes to the TCS will mean that you agree to and accept such changes. In addition to the TCS, when using particular Prescription-Mexico.com services, you and Prescription-Mexico.com will be subject to any posted guidelines or rules applicable to such services which may be posted from time to time. All such guidelines or rules are hereby incorporated by this reference into the TCS.  
  2. Overview of Service. Prescription-Mexico.com currently provides users with access to medication name information, pharmacy listings and a vast range of other content (collectively the "Service"). Unless explicitly stated otherwise, any new features that augment or enhance the Service, including the release of new products or services, shall be subject to the TCS. You understand and agree that the Service is provided "AS-IS" and that Prescription-Mexico.com assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.
  3. Your Registration Obligations. In consideration of your use of the Service, you agree to be legally bound to the TCS as if you had signed this Agreement.
  4. Privacy Policy. Prescription-Mexico.com is concerned about the privacy and safety of all its users. Prescription-Mexico.com does not collect, track or otherwise store any personal information of users of the Service. Any exchange of information between listed pharmacies and their customers is governed by the pharmacies’ respective privacy policies.
  5. You acknowledge that Prescription-Mexico.com does not pre-screen Information; but, that Prescription-Mexico.com shall have the right, but not the duty, in its sole discretion to refuse or move any Information that is available via the Service. Without limiting the foregoing, Prescription-Mexico.com shall have the right to remove any Information that violates the TCS or that it, in its sole discretion, deems objectionable. You agree that you must and are able to evaluate, and bear all the risks associated with, the use of any Information, including any reliance on the accuracy, completeness, or usefulness of such Information. You acknowledge that you may not rely on any Information created by Prescription-Mexico.com or submitted to Prescription-Mexico.com, including, without limitation, information in all parts of the Service.
  6. International Use. The Internet provides global access to the Prescription-Mexico.com web site. Prescription-Mexico.com has taken preventative measures to comply with all applicable laws regarding the transmission of data from the United States. As a user of the Prescription-Mexico.com web site, you agree to comply with all local rules regarding online conduct and acceptable Information, including, without limitation, all applicable laws regarding the transmission of data exported from the United States or the country in which you reside. Also, you agree to comply with all rules regarding online conduct and acceptable transactions with any listed pharmacy or advertiser.
  7. No Resale of Service. You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service.
  8. Modification of Service. Prescription-Mexico.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Prescription-Mexico.com shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
  9. Dealing with Advertisers and Listed Pharmacies. Your correspondence or business dealings with, or participation in promotions of, advertisers or pharmacies found on or through the Service, including, but not limited to, payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Prescription-Mexico.com shall not be responsible or liable for any loss or damages of any kind incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.
  10. Links. The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. The links are provided solely as a convenience to you. You acknowledge and agree that once you enter such links, sites or resources you have left the Prescription-Mexico.com web site. Prescription-Mexico.com does not review the content of the sites and resources, nor does it have any control over such sites and resources. Therefore, you acknowledge and agree that Prescription-Mexico.com is not responsible for the availability of such external sites or resources, and it does not endorse and is not responsible or liable for any Information, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Prescription-Mexico.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be used by or in connection with use of or reliance on any such Information, goods or services available on or through any such site or resource. If you choose to access any of these links, sites or resources, you hereby acknowledge and agree that you do so entirely at your own risk.
  11. Prescription-Mexico.com's Proprietary Rights. You acknowledge and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Information contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Prescription-Mexico.com or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or Software, in whole or in part.
  12. Disclaimer of Warranties. YOU EXPRESSLY UNDERSTAND THAT AND AGREE THAT:
    1. YOUR USE OF THE SERVICE IS AT YOU SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. PRESCRIPTION-MEXICO.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
    2. PRESCRIPTION-MEXICO.COM MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, EFFICIENT, OR ERROR FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCT, SERVICE, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.
    3. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN RISK AND DISCRETION. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
    4. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM PRESCRIPTION-MEXICO.COM OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TCS.
    5. NEITHER PRESCRIPTION-MEXICO.COM NOR YOU MAY MODIFY OR WAIVE THE DISCLAIMERS PROVIDED FOR IN THIS SECTION 12. NO ORAL MODIFICATIONS OR WAIVER OF THIS DISCLAIMER SHALL BE VALID OR BINDING ON PRESCRIPTION-MEXICO.COM.

  1. Limitation of Liability. BY USING THE SERVICE YOU AGREE TO ASSUME ALL RISKS ASSOCIATED WITH SUCH USE. YOU EXPRESSLY UNDERSTAND AND AGREE THAT PRESCRIPTION-MEXICO.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF PRESCRIPTION-MEXICO.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE, (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
  2. Exclusions and Limitations. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMIT OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 12 AND 13 MAY NOT APPLY TO YOU.
  3. Disclaimer Regarding Shopping Retailers. The Service provides shopping services to help you locate and potentially purchase products from online and offline retailers. Prescription-Mexico.com provides access to these independent retailers merely as a convenience for you. Prescription-Mexico.com, however, does not control these independent retailers and Prescription-Mexico.com does not provide any assurance, warranty or guarantee of any kind that you will be satisfied with products or services purchased from independent retailers. You hereby acknowledge and agree that if you use the services of or purchase products from these independent retailers, you do so entirely at your own risk and upon the terms of the independent retailers.

    When shopping by means of the Service, you acknowledge and agree that Prescription-Mexico.com does not endorse any of the products or services not provided for by Prescription-Mexico.com but are linked to from the Service, nor has Prescription-Mexico.com taken any steps to confirm the accuracy or reliability of any of the information provided by third parties through Prescription-Mexico.com or their own web sites. Prescription-Mexico.com expressly disclaims any and all representation or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third party. We advise you to exercise your own judgment and investigate as you deem necessary before you proceed with any online or offline transaction with any of these third parties. You also agree to verify and comply with your local laws before proceeding with any online or offline transaction with any of these third parties.
  4. General Information. The TCS constitute the entire agreement between you and Prescription-Mexico.com. They govern your use of the Service, superseding any prior agreements between you and Prescription-Mexico.com. You may be subject to additional terms and conditions. You shall not assign your rights or obligations under the TCS. You shall not make nor agree to make any commercial use of the web site or any other Prescription-Mexico.com service or product. The TCS and the relationship between you and Prescription-Mexico.com shall be governed by the laws of the State of Florida without regard to its conflict of law provisions. You and Prescription-Mexico.com agree to submit any and all controversies or claims to the District Court of the County of Palm Beach, Florida, and that such court shall have exclusive jurisdiction, including in personam jurisdiction and shall be the exclusive venue for any and all such controversies and claims except as otherwise unanimously agreed by the Parties. The failure of Prescription-Mexico.com to exercise or enforce any right or provision of the TCS shall not constitute a waiver of such right or provision. If any provision of the TCS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TCS will remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TCS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

    The section titles in the TCS are for convenience only and shall have no legal or contractual effect.
